A Home moving guide

Charles Henley Solicitors undertake to manage all aspects of your property move. The conveyancing process includes the following:

On a sale

  • We will begin by writing to you, setting out terms of business and confirming the quote given in respect of costs and disbursements.
  • Once you have confirmed instructions, we will obtain your deeds and the necessary documentation from the Land Registry to enable us to prepare the draft contract and supporting documentation which will then be sent to your Buyers Solicitors for their approval.
  • Upon receipt of any enquiries that the Buyers Solicitors may raise concerning the documentation and the results of the Buyers Solicitors searches, we will reply to them as appropriate.
  • We will then send to you the contract for you to sign, which we will hold until the Buyers Solicitors and the rest of the chain are ready to proceed.
  • Once the whole chain is ready to proceed and a completion date has been agreed, contracts will be exchanged, which is the point at which you become legally bound to the transaction.
  • If you have a mortgage, we will then apply to your mortgagees for a redemption statement showing the amount required to pay off your mortgage as on the completion date.
  • Upon completion of the transaction, once the completion monies have been received, we will pay off your mortgage and pay over to you any balance that may be due to you.

On a Purchase

  • We will begin by writing to you, setting out our terms of business and confirming the quote given in respect of the costs and disbursements.
  • Once you have confirmed instructions, we will write to your Sellers Solicitors, asking them to send to us the necessary draft contract and supporting documentation.
  • Upon receipt of the draft contract and documentation from your Sellers Solicitors, we will apply for searches and raise any additional enquiries concerning the same which we consider necessary.
  • Upon receipt of satisfactory replies to searches, enquiries and mortgage instructions (if applicable) we will either report to you in writing or make an appointment at our office to go through the contract documentation with you prior to your signing the contract.
  • Once everybody in the chain (if there is one) is ready to exchange contracts and a date for moving has been agreed, the transaction may proceed to exchange of contracts, whereupon all parties to the transaction become legally bound.
  • We will then apply to your Financial Lending Institution for the mortgage funds (if applicable) to be released in time for completion and also ask you to remit to us any balance of funds that may need to complete.
  • Upon completion we will telegraphically transfer to your Sellers Solicitors the amount required to complete whereupon the completion documentation including the deeds will be delivered to us.
  • After completion we will deal with Stamp Duty Land Tax and the Registration of the Transfer at the Land Registry.
